General Permit TXR040000 for Phase II (Small) MS4s

On August 14, 2024, the Commission adopted the 2024 TPDES Phase II (Small) Municipal Separate Storm Sewer System (MS4) General Permit, TXR040000. The renewed general permit was issued and effective on August 15, 2024.
Existing small MS4 permittees and newly regulated small MS4s (due to the new or expanded urban areas with a population of at least 50,000 people in the 2020 Decennial Census) have 180 days from the effective date of the 2024 general permit to submit a Notice of Intent (NOI) or a Waiver application, as appropriate. Applications must be submitted by February 11, 2025.
Small MS4s must first develop or update their Stormwater Management Program (SWMP) to address the 2024 general permit requirements prior to submitting the complete NOI and $400 application fee to obtain authorization to discharge.
The NOI or Waiver must be submitted electronically via the NPDES Electronic Reporting Tool for MS4s (NeT-MS4 ) online electronic permitting system, unless the MS4 operator requested and obtained an Electronic Reporting Waiver.
Small MS4 operators that are granted an Electronic Reporting Waiver must submit the application on a paper NOI or Waiver form provided by the executive director. Contact the TCEQ Stormwater Team to obtain the Request for Electronic Reporting Waiver Form (TCEQ-20754). This form must be submitted along with submittal of a paper application (NOI or Waiver) for authorization under the 2024 general permit.
NOTE: Existing small MS4 operators must continue to implement ongoing items in their most recently TCEQ approved SWMP until a renewal NOI is submitted and approved under the 2024 general permit.
2024 TPDES General Permit for Phase II MS4s
The 2024 Phase II MS4 General Permit, TPDES Permit No. TXR040000, was issued on August 15, 2024. It authorizes the discharge of stormwater to surface water in the state from small MS4s.
